It is prohibited to use the Website for commercial purposes or in any way considered to be in our sole discretion, unlawful or harmful.

Terms and Conditions of Sale


We encourage you (hereafter referred to as the consumer) to read these terms and conditions of sale carefully before proceeding with any purchase. By making any purchase the consumer fully accepts these Terms and Conditions of Sale.


Subject


Purchase of products and subscriptions to Memory Hive publications offered for sale on this website owned by Memory Hive Productions and entered into remotely via computer networks are governed solely by these general conditions of contract.


Memory Hive oversees the full management of the individual sale, subscription sale and the despatch (not delivery) of the products.


Parties


These terms and conditions shall exclusively govern sales contracts concluded with consumers - understood as those natural persons acting for purposes which are outside his/her trade, business or profession - and Memory Hive.


This means that products offered on sale on this website are addressed to consumers who purchase for personal use only and not to those who purchase for commercial purposes (e.g. re-sale, even if in forms which are different from the original form, individually sold or combined with other products, used as prize for contests and similar activities, etc.).


Conclusion of the Contract and Acceptance of the General Conditions of Sale


Contracts for the sale of the products offered for sale on this website shall be deemed concluded when the payment of the transaction has occurred.


Memory Hive will promptly send the consumer an email receipt for the purchases made by the consumer.


Your Story


Before a contract is drawn up because the consumer has agreed to tell their story to Memory Hive, with the intention of Memory Hive producing for them a high-quality paperback and/or electronic autobiography (referred to simply as Your Story), Memory Hive and the consumer will agree on a price (which will include an initial agreed deposit) and proposed timescales for the process. The price and proposed timescales are dependent on the length of Your Story. The price and proposed timescales will then be confirmed within the contract which the consumer will be required to sign and return to Memory Hive with the initial deposit within 30 days of the date of the contract. Memory Hive reserves the right to revise the timescales while the process is underway.


Memory Hive reserves the right to cancel the process at any point should they feel the subject matter/images to be offensive, likely to give offence or are of a criminal nature. In the case of the latter, the relevant authorities may be informed. The consumer has the right to cancel the process if they decide they no longer wish to continue for any reason. In either of these circumstances, any monies paid to Memory Hive will be refunded to the consumer minus the initial agreed deposit.


Your Story will be privately published by Memory Hive. It will not be commercially available at any point, meaning it will not carry an ISBN number nor can it ever be ordered from a commercial trader, either online or in a physical store. Your Story will only ever be made available to the consumer whose name appears on the contract and not to a third party.


Consumer Obligations


The consumer is required, prior to submitting any purchase order, to read these terms and conditions of contract carefully. Purchase order forwarding involves their full knowledge and acceptance.


Consumer undertakes that all the information and data provided on the website are correct and acknowledges that the personal data provided will be used by Memory Hive to deliver the Products purchased on the website. Memory Hive cannot be held accountable for products not received due to some incorrect personal data filled in on the website.


Age Restrictions


Children under the age of 18 are not permitted to purchase products from our websites. Memory Hive accepts payments in good faith that the consumer purchasing products is 18 and over.


Payment Method


Payment for purchases can be done solely by credit card via PayPal and can only be made by the owner/holder of the credit card.


The payment procedure involves the insertion of the credit card's information through a secure connection at the payment gateway, which guarantees a high degree of safety: Memory Hive, in fact, will not come to know the consumers credit card number, that will pass directly from the browser to the payment gateway managed by the circuit's, without being stored by Memory Hive or others. Therefore, Memory Hive cannot in any way be held responsible for fraud or illegal credit card use on their own sites.


Subscription to and purchase of The Dean Martin Association Journals part-work


Please note that the purchase of a subscription sold on this website involves the conclusion of a contract of sale with Memory Hive Productions and the order processing will take place from UK territory. Each individual issue of The Dean Martin Association Journals part-work (hereafter referred to simply as DMAJ) will be published monthly from March 2023.


a)     Disclaimer

The material contained within DMAJ ranges from 1960 to 2011. The master documents, from which high-quality scans have been taken, vary in print quality due to the historic duplication methods used. Memory Hive must therefore stress that some of the reproductions contained are difficult to read clearly in parts but have been included to make the DMAJ comprehensive as an historical record. Memory Hive has also removed personal/contact details of some persons and organisations mentioned, so on occasion there are passages of text blanked out or cropped. Some content of DMAJ might include material that reflects historic grammar, sensibilities and attitudes and must be accepted in good faith as such by the consumer and without meaning offence to any party or individual. The consumer understands this disclaimer prior to purchasing an individual issue of or subscription to DMAJ as no refunds will be offered and no returns will be accepted for individual or multiple copies already purchased.


b)     Delivery of Products

Unless otherwise requested the subscription will start with the first available issue of DMAJ. This will be despatched to allow for third party carrier delivery within 6 weeks of the order being placed for UK delivery and around 8 weeks for Overseas delivery. We will endeavour to meet any date agreed for despatch. If for any reason this despatch cannot be met, Memory Hive will not be liable for any losses, costs, damages or expenses. Despatch of the magazine will be made to the address specified in the order and the consumer will need to make all arrangements necessary to take delivery of the Goods from the third party carrier whenever they are tendered for delivery.


c)      Right of Subscription Withdrawal

The consumer may exercise the right of withdrawal foreseen by the Distance Selling Regulations. In particular, the consumer is entitled to withdraw from any contract with Memory Hive without specifying the reason within the term of 14 working days from the receipt of the Products.


The right of withdrawal is performed by forwarding a letter to Memory Hive's address indicated below.



In case of exercising the right of withdrawal, the notification must be sent to the following address, to the attention of "Customer Care" Office: admin@memoryhive.co.uk


If the right of withdrawal is exercised by the consumer pursuant to the provisions of this clause, Memory Hive is obliged to reimburse a proportional amount (calculated by the length of time the subscription has been running and/or how many issues of DMAJ have already been issued by Memory Hive) paid by the consumer within 14 days from the date Memory Hive receives the communication sent by the consumer about his decision to withdraw from the contract.


d)     Refunds and Cancellations

Customers may cancel their new subscription order to DMAJ within 14 days of their initial order purchase. Please note that refunds are offered at the discretion of the publisher.


Applicable Law and Jurisdiction


This contract is governed by English law and subject to the jurisdiction of the courts of England and Wales.
